Applicability to entrepreneurs and definitions of terms
(1) The following General Terms and Conditions of Business apply to all deliveries between us (Maximus Modellbau) and a consumer in the version valid at the time of the order.
A consumer is any natural person who concludes a legal transaction for purposes which are predominantly neither their commercial nor their independent professional activity can be attributed (§ 13 BGB).

Terms of delivery and payment domestically
The delivery takes place exclusively against payment in advance, by bank transfer or Paypal payment to Maximus-Modellbau. When paying by PayPal from abroad, we charge a payment fee of 3.9%, for payments from Germany 2.5% on the total invoice amount including shipping costs. When ordering, you will receive an order confirmation in the form of a textual confirmation by e-mail. If you do not have an e-mail address, you will receive an invoice / order confirmation by letter. Please make payments only after receiving the invoice.
The purchase agreement is only valid upon receipt of your payment or shipment of your order by us as closed.
We charge a shipping fee of 7,20 EUR.
We keep ordered goods ready for delivery within 10 days.
The goods are made on request, which is why we make a delivery within 10 working days.
If no payments have been received by then, the order will be canceled.
We deliver exclusively by DHL or Deutsche Post AG, either as an insured parcel or for small quantities as registered mail.
Cancellation
Right of withdrawal for distance contracts according to §312d BGB:

You can cancel your contract within two weeks without giving reasons in writing (eg. letter, e-mail) or - if the case before the deadline - by returning the goods. The period begins after receipt of this instruction in writing, but not before receipt of the goods at the recipient (in the case of recurrent delivery of similar goods not before the receipt of the first partial delivery) and not before fulfillment of our information obligations in accordance with § 312c para 2 BGB in connection with § 1 para. 1, 2 and 4 BGB-InfoV and our obligations pursuant to § 312e para. 1 sentence 1 BGB in connection with § 3 BGB-InfoV. To the future the right of withdrawal is the right temporal limitation of the cancellation or the thing. The withdrawal is adressed to:

consequences of Withdrawal
In the case of an effective cancellation, the services received on both sides are to be returned and, if applicable, withdrawn (eg interest). If you can give us back the received performance completely, or partially not, or only in a deteriorated condition, you must pay us compensation for the value. In the case of the surrender of things, this does not apply if the deterioration of the thing is solely due to their examination. Incidentally, you can avoid the obligation to pay compensation for a deterioration caused by the intended use of the item by not using the item as your own property and refraining from doing anything that impairs its value. Transportable items are to be returned at our risk. You have to bear the costs of the return, if the delivered commodity corresponds to the ordered and if the price of the thing to be returned does not exceed an amount of 40 euros or if you at a higher price of the thing at the time of the revocation still not the consideration or a contract agreed partial payment. Otherwise, the return is free for you. Non-parcels are picked up at your place. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of your revocation or the thing, for us with their receipt.

Delivery to foreign countries:
Delivery takes place only against prepayment by bank transfer or PayPal payment. When paying by PayPal, we charge a payment fee of 3.9% on the total invoice amount including shipping costs. When paying by bank transfer, the transferor assumes all accruing own and third party bank charges and costs. You will receive an invoice. Please transfer only after you have received the invoice.
Shipping costs are calculated individually depending on size, weight and country of destination of the shipment to be delivered.
We will inform you as soon as possible about the shipping options and their costs. A sales contract comes only after approval or by payment conditions. Any costs, such as taxes or customs duties, for the importation of goods into the respective country shall be borne by the buyer.

The goods remain our property until full payment.

Severability clause:
Should one or more provisions of this contract be wholly or partially invalid, this shall not affect the validity of the remaining provisions. The ineffective provisions shall be replaced by a provision which is as similar in content as possible and which comes closest to the purpose of the intended provision.
